It’s been a long time but I had been extremely tied up with the academic commitments. I promise to return to full time blogging once I am free from them.

Over the past few months, I have become cautious about the privacy on the net. One of the first moves was to switch over the name to Administrator. I had already moved away from Google; but more importantly, the last vestige was Google Reader; this too was given the boot in favor of Newsblur an independent developer based in New York and an excellent news reader.

Apart from this, I strongly recommend Ghostery and Noscript add-ons for your Firefox.

I have been following the 2G and the 3G scam but unfortunately, due to political compulsions, nothing has come out of the Supreme Court order. The key players are all out of jail. So all that drama that ensued was all for the show. Apart from this, there is no concrete action on ground regarding anything new in the pipeline, barring the 4G that is in the air. Airtel is rumored to launch it soon in key areas and beyond the wireline, Airtel is hoping that it would be a key determinant for it’s bottom line. Of course, the restrictions for “limited broadband” remain on course. You are unlikely to see “all-you-can-eat broadband” anytime now.

Interestingly, there is a trend of co-branded handsets for bundled offers for data. It’s not a sign of matured markets but rather a sense of desperation on part of the telecom companies to be able to sell anything. I don’t have any clue about the development of mobile apps but with overt reliance on Android to drive Google’s penetration in the heartland, mobile phones are slowly becoming ubiquitous. Well, there are more mobile phones than the toilets in this country!

Lets wait and watch for 4G. Lets see how it works out. I’d be back soon.

I have experimented with the tone and tenor of the write ups here. It’s impossible to update on a daily basis although RSS as a delivery mechanism is very powerful in it’s context; it’s easy to set up feeds to keep the blog updated regularly.

However, I personally feel that the sector as a whole has not evolved to a meaningful extent to report on the events. Vodafone has been dragged to the court. Airtel has botched up it’s 3G offerings. 2G scam has caught up with its final actors. However, this is still the “tip of the iceberg”. A lot goes behind the scenes and some unlucky few get caught up in the swirl. Indeed, they are just minor fronts for the systematic loot.

Writing on all this is a chore. It’s pathetic to repeat the same thing ad-nauseum.

Image via Wikipedia

Hence, I prefer to write when I get a sudden burst of “inspiration”. This blog has definitely morphed from it’s rigid confines of Indian Telecom to something more of a “digital narrative”.

I could also write on the operators elsewhere; unrestricted data does not flow uniformly. Yet, in most of the developing countries, scarcity is something that is engineered. It holds no relevance for most of us to know about what AT&T is doing with it’s T- Mobile acquisition. Further, we have distanced ourselves, not only from the advertising, but also from reporting any industry sponsored events. I routinely get invitations (off and on) but they are mostly from clueless PR executives.

Daily updates is beyond the scope. Writing is a passion and needs to be stoked. Yet, there is no point in being pointless either!

For long, I have felt the need to do a “consumer survey” which is motivated by real customers than the paid for shit stuff that most telecom operators crow about. It is impossible to capture data from the cross section of the user population and the retards who crowd on the forums would not be able to grasp the import of this exercise.

I realize the difficulties inherent in this exercise immediately. First and the foremost is lack of actual “complaint data”; TRAI does put up the figures online but there is a mechanism where these operators have to report back the action taken on the complaints. This is a good mechanism but I don’t see it enforced or whatever TRAI does, they are clueless idiots to make this data work for a better policy formulation.

Ditto for the existing delivery of the complaint mechanism. An aggrieved customer calls the operator in call center, is given a complaint number (not always) and no time frame for the resolution. I am presuming that their workflow is designed for the said purpose. Like any corporate organization working on “cost savings”, this is possibly “outsourced”. A smart team utilizes “dumb terminals” clogging up the bandwidth for most of “executives”. All the while, these brainless sods make the customers wait even more utilizing the spectrum.

This is a “presumption” but this workflow is bound to keep the customers “unhappy”. Billing and metering issues are definitely top of the list; unfortunately, even these thorny issues are not resolved in their entirety.

What needs to be done? Actually, this could easily be a dissertation exercise, capture and visualize the data and present a solid case report to the telecom companies. However, the implementation needs money and I am unlikely to see any movement on that count.

I could help with some possible criteria; reach me on the email (under “contact”).

One more thing. Reliance, Aircel and Airtel easily top the shit list.

An overtly maniacal Government now wants a lawful interception of video calls on 3G networks.

The blurb:

There were problems in interception facilities of video calling on 3G services, which needs to be addressed before the launch. The operators have said monitoring facility of video calls was not available anywhere in the world and the operators were talking to vendors to find out a solution.

The government wants real-time interception by which the security agencies could monitor/intercept video calls as it happens.

Understandably, 3G in India has caused more issues than it has solved.

Unfortunately, the International Telecommunication Union (ITU) has provided a 2005 document on definition of 3G data rates (to quote):

ITU has not provided a clear definition of the data rate users can expect from 3G equipment or providers. Thus users sold 3G service may not be able to point to a standard and say that the rates it specifies are not being met. While stating in commentary that “it is expected that IMT-2000 will provide higher transmission rates: a minimum data rate of 2 Mbit/s for stationary or walking users, and 384 kbit/s in a moving vehicle,”[18] the ITU does not actually clearly specify minimum or average rates or what modes of the interfaces qualify as 3G, so various rates are sold as 3G intended to meet customers expectations of broadband data.

This causes issues in clear definition of 3G rates that would be expected of these companies to provide us with. This confusion also means that we are in the same league as broadband- no clear definition and companies can murder and get away with.

Suppose if you were to file a case against, say Airtel or Reliance for “speed issues”. They can always get away with “network congestion” argument. Further, in court of law, TRAI could be answerable for it has failed to set a clear cut idea about 3G (being the regulator) and companies claiming the excuse for TRAI’s inefficiency.

As a customer, you are bound to get a short fuse for being cheated on a gargantuan scale for “higher prices” which is now being sold as a value added service in addition to bundling with voice calls. 3G (in the media) has been hailed as the “next wave of broadband” which is clearly unfortunate case of irrational exuberance.

I have tried to contact Business Standard on fine tuning their editorial content and at least their coverage on Tech issues in India. It is the worst case scenario with rehashed press releases as “news” raising the spectre of “paid media news”. These are often attributed to “BS reporter” and is really pathetic for a newspaper of it’s standing and repute.

In the same vein, although much is made about video calling (at least by those who have front facing cameras), I wonder how would the call clarity be.

I hate this murky world, the obvious excess of advertisements and absolutely no semblance of sensibility and rationalism. This only points towards a total state of anarchy but when the customers by themselves lack any means to differentiate chaff from the grain, I have no love lost for the masses. Let them get screwed; this is testified by occasional mails in my inbox complaining about the poor quality of service and mails to Ambanis and Bhartis and what not. Assholes.

In all this mess, I fail to get the kind of service I would want- pure play wireline fiber optic cable with at least 2 Mbps unmetered and perhaps wireless for restricted mobility and occasional odd job that needs to be done of the fly. EDGE is good enough for the needs; basic emails work great on that.

I decided to stick around after lunch time today to file in the application. It is a simple process. One has to purchase a postal order (from any post office in the country), attach it to the application after filling in the details on postal order (for 10 bucks) and you are good to go.

Submit it to the PIO and wait for the answer from them. I wonder what has been the reaction from their office after getting a detailed questionnaire. Lets wait for the answers (next year).

I am keeping my fingers crossed. My contention is that you make the top incumbent come clean on the prices which would help you to negotiate the prices with say Airtel. At least I would have a broad idea as to how the revenues are split, what are the issues that need to be sorted out and confront TRAI with the same to issue policy decisions (perhaps Department of Telecom too).

I think, all it needs is a simple will to do something instead of getting mired in the red tapism. I have already written to the DoT Secretary (R Chandrashekhar) but he has not replied so far. I am not even sure whether the email has landed in his inbox.

Some time later next year, if everything goes well, I might plan to meet him in person.

The idea is to get broadband liberated; so that at least I get the best value for my money. I’d rather have a functional DSL first for starters; fiber can wait for some time.

I was also surprised to see BSNL’s equivalent IPTV packages in their customer care. I am not sure how this would work out or what is the customer review. Although it is a good option for time shift TV but with bundled speeds of 256kbps, I am not eager to join them. With customer resolution at local BSNL exchange, I am not keen to run around to get my service fixed in case of any “issues”.

Lets keep our fingers crossed.

A couple of days back I had written about cloud computing; whether or not it is relevant to Indian scenario given the state of the broadband networks and how they function. 4G is not yet launched and we still have to see it’s widespread deployment.

It can also be argued that Cloud computing offers a “cheaper alternative” for net access. For all the noise behind Chrome OS, it remains a re-worked implementation of Linux under the core with fancy “apps” and the browser as central to the computing experience.

To be honest, I hardly use my laptop for anything else. My computing time is solely meant for web access and once Google Voice/Skype have sense enough to implement the technology across the browsers, the other mode of “desktop applications” would become redundant.

It can also be argued about Google OS to be a cheap and effective way to roll out the product or say something like Airtel coming up with a fancy idea of having Airtel-Google branded laptops or netbooks being given “free” with contracts. However, for all this optimistic line of thought, I feel that the market is still not ripe to jump the gun.

Lets see what does Eric Schmidt has to say about it:

With Chrome OS, we have in development a viable third choice in desktop operating systems. Before there was no cloud computing alternative—now we have a product which is fast, robust and scalable enough to support powerful platforms. It’s something computer scientists have been dreaming about for a very, very long time. The kind of magic that we could imagine 20 years ago, but couldn’t make real because we lacked the technology. As developers start playing with our beta Cr-48 Chrome OS computer, they’ll see that while it’s still early days it works unbelievably well. You can build everything that you used to mix and match with client software—taking full advantage of the capacity of the web.

Ignore the brave words.

There is a competing product from Google: Android. It can again be effectively argued that they are separate and none can be adapted for other usage. I digress.

Android, despite ruling the roost on the mobile handsets, needs a lot more polish and push from Google to make it auto upgradeable. I own one from Samsung and hate the loaded crapware. I’d have to flash the ROM and install something else but that’s left from some other day.

Yet in this saga, can Google ever hope to monetise it’s offering? I can assume that after the Chrome OS reaches a critical mass (if and ever), it would be flooded with advertisements. Owning a laptop with loaded Chrome OS is the perfect platform for targetting those niggly ads that guarantee you a better erection in bed. In any case, the volumes are going to come only from the enterprise and that is not going to change in a hurry.

Brave words indeed but here’s a sampling of the common sense that has prevailed in the dark corners of cyberspace:

And any reasonably competent IT executive can plainly see that Google, for all of their algorithmic might, isn’t known for product longevity.

Sure, their core web products have been around for a while and aren’t going anywhere. But they launch a lot more products every year that we quickly forget about, and many of the unsuccessful products are quietly discontinued a few months or years later.

Google’s just not in the business of providing long-term support for an unsuccessful product line. It’s part of what allows them to keep releasing new things all the time while geeks declare Microsoft a boring old dinosaur. But IT departments need their platform vendors to behave much more like Microsoft.

Sad but true.

Hence, in this scenario, I don’t foresee a bright future but it seems to be another flash in the pan from the mavericks. It’s hard to say how this shapes up, how they advertise or strike deals with the manufacturers or how they wish to tone up their advertising platform.

There are things that don’t cease to amaze me. Top of the mind recall is the massive “re-structuring” exercise to “re-brand” Airtel “logo”. It is rumored that the entire jing bang cost them nearly 300 crores.

If that is the case, lets see what 300 crores can get. For once, they could have invested in better human resources, beef up their call centers (instead of out sourcing them to dick heads), lay down more lines for broadband, subsidize the access to resources and extend fibre to my premises, if at all.

Of course, those on mobiles would say that this is good serious money to tone up the network and perhaps improve the service delivery front.

No nothing of that sort happened.

Instead we have Sunil Bharti Mittal sporting a T Shirt emblazoned by his logo (in Delhi’s winter chill, perhaps) posing on for the cameras splashed on the news papers. Hey look, thats what serious money can get you. Publicity. Which also means that none of the “serious questions” would ever be raised.

Why this sudden change? Does Airtel want to reflect on it’s global image and makeover? I am not an expert in these matters but seriously, I don’t ever give a F to the logo change. No one gives a damn to a company they are dependent on for their mobile telephony needs and I see Airtel morphing into another BSNL, a tired run of the mill operator who has ceased to “delight”.

Blame it on my cynicism or year end blues or whatever. As this blog grows in it’s age (and perhaps maturity and depth), I see the same old jaded faces and “excitement” at the “fastest growing industry”. Lies and damned lies.

Perhaps the idiots would ever bother to ponder and reflect on the wasted 300 crores. As someone on Twitter had pointed it out that it resembles a worm squiggling over splattered red paint. I am not sure how accurate this comment really is but well there is a good take on Faking news.

I think that they have screwed it up given the fact that BSNL has upped the ante as far as tariffs are concerned. I think that there is a going to be a big market for the data cards given the pathetic landline access.

Interestingly, here’s something from the Tata’s end user agreement:

…is not strictly limited to India.

Yes, you heard me. India is not the only country with FUPs – check some ISPs abroad. I dare you.

While I support the move to increase the lower-limit to 2mbit/s, the reason for the ISP’s opposition to this is obvious: the financial implications are huge. BUT SPEED DOESN’T COST: Gigabytes do.

All differ depending on the technology in question, but generally speaking I can deliver you 1 gigabyte at 1, 20, 50 or 100 megabits and with a small variation in the actual cost of the equipment (ADSL, VDSL, Fiber), it costs me basically the same. Consider now the various plans available from Airtel, BSNL, Tata, Reliance and others with roughly the same size data-cap: with a price difference based strictly on speed. Doesn’t that piss you off?

(Case in point: Airtel’s 30 and 50mbit/s plans. Both 200GB data caps. Delivered at 30mbit/s or 50mbit/s. Price: Rs1,000 different). #FAIL

So while the slow speeds and tiny data-caps and FUPs may seem like profiteering now, at the current pricing levels (under Rs2000), mandating an increase to a minimum of 2mbit/s (which I personally am hoping for) to call the product “Broadband” would seriously damage profitability of ISPs whose costs can be up to Rs20/GB – or more (depending on their negotiating skills!)

That is, unless some things change.

First: wholesale prices need to come down - 1Cr per year for 155mbit/s is outrageous (even 50 lakhs is still outrageous). On USA-UK, Singapore-USA, Japan-USA, you can get 10Gbit/s for about US$10k/month.

Considering that of all the capacity to India (total is about 20-23 terabits right now) the total usage is still only being measured in gigabits, it’s clearly not a capacity problem, it’s a price problem.

Secondly, NIXI’s tariff structure to be changed to a flat-rate – nowhere else in the world charges per GB at the peering-exchange! In fact, I’d be happy to pay Rs3,00,000 per MONTH for 1gbit/s if the per-GB charges were eliminated.

Thirdly, Local Loop Unbundling – I would suggest (both as an foreigner and as someone starting an ISP) that this be done as soon as possible. Yesterday is better. In fact, it should have been done in 2004 when it was suggested originally – perhaps India would not be in the situation it is now.

But if it is done, then we can eliminate dependence on cablewalas, as they aren’t helping India’s Broadband situation, and BSNL/MTNL can start to get another revenue stream from ISPs who want to lease the copper.

Of course, I outlined all of this in the document to which Sushubh & I contributed but the author of this article (Caught in the Net of slow broadband) sort of failed to mention… well… almost all of it.

So as a consumer, I disagree with FUPs in general. As an ISP/business owner, I see the point of them and that they are a necessary evil.

So what’s my comprimise?

We don’t need to eliminate FUPs completely, just for the FUPs to be fair to the consumer.

This post was originally posted as a comment to the online version of the ToI article mentioned above, but at the time of writing had not been moderated/accepted. It has been modified from it’s original form for some clarification and comic effect.

I am not getting huge amounts of traffic since it not context linked extensively and the blog is seeing a drop in the rankings. Part of the reason is that there are a huge number of copycats who copy the content and post it under various heads to fragment the traffic for the advertising revenue. Further, I have been very slow to post here because of my prior commitments.

Anyway, I am glad that I have had to put up the comment moderation. It makes it easier to track the overall blog and see how it is faring. I get tonnes of comments on Reliance, people complaining about the same and resumes. I am not even sure that any dickhead from that company would even bother to read the way the companies are screwing around. For the minority, it is a daunting task to search and then land up on the blog thinking this to be a company website.

Nevertheless, I am posting a comment in it’s entirety for the kind of morons who populate the world. This of course is a sad reflection on the standards of our education but worse still, the lack of content in regional media. English is an alien language but then we pay for their rule!

Nevertheless, enjoy and have a good laugh!

This was the update on a write up on The Economist about the telecom networks using “network analysis” which in short meant that one looks for patterns in random activities. Interestingly, they gave the example of Bharti Airtel which I quote,”

“Instead of looking at the call records of a single customer at a time, it looks at customers within the context of their social network. The ability to retain customers is particularly important in hyper-competitive markets, such as India. Bharti Airtel, India’s biggest mobile operator, which handles over 3 billion calls a day, has greatly reduced customer defections by deploying the software, says Amrita Gangotra, the firm’s director for information technology.”

If anyone of you piss crap dip shit idiots is reading this, sorry to say but you are betting on wrong horses. If IBM has sold you expensive software, it has ROYALLY screwed you. Numbers make very good presentations, Airtel. If you are trying to bring in some generalization in the heterogeneous market, you are falling flat on your face.

Airtel, may I remind you that you have not become the “preferred mobile operator” because you are good, but because in most of the cases, people have no REAL choice. If facts speak for themselves, please lay out the exact number of subscribers in your network, your network utilization, the number of actual post paid customers and how you cheat the crap out of people on prepaid networks.

Your Broadband business is best in terms of service but stunted because of POOR REACH and you dumbfucks have not been able to add on ANY value to it. All your marketing muscle has failed. Even when I switched over my circle, your retention team was unable to convince me to stick on to Airtel. It is so bad.

I am a customer; you got to kiss my ass and not other way around. A fancy piece of shit with hired dumbfucks is not going to change the perception. Unfortunately, you tend to ignore the hugely vocal minority spilling out their venom because of your shoddy services while you are busy palming off a huge majority of the dumb fuck retards. Sad, very sad.

What really is required is to shake off the lethargy, spread your broadband network further, cut down on the crapware you’ve bought and kick out those fancy moronic MBA’s who don’t give a shit to your brand. Start listening to your customers. Trust me, you don’t need to look for “computer generated patterns”; but make the existing mode of services to deliver their maximum value.

It would pay off more than you anticipate.

I have fired an email to their top heads and of course, I need to make them realize that they are PUBLIC SERVANTS first and not our lords. To this effect, I am planning to file another RTI as soon as possible given the constraints on my time and energy.

The latency sucks to the core. Maybe I have been used to the 1Mbps madness. Where it took 2 hours to download a 700 MB file. Where everything worked in a jiffy. Where there was a slightly better customer care. Where things seemed to happen. Somewhat. But then we are stuck with a frigging glacier! BSNL crawls where it has to drag it’s feet. Shit.

How would it feel to subject these arseholes to a nice Chinese Water torture and spike their balls with massive gushes of high voltage and rip them apart? Perhaps they are used to their slumber.

The incumbents had a cosy oligopoly. Their talk plans were similar with no real service differentiator. The new players have changed the equation with “per second plans”. The best part is, according to media reports, is that the monopoly of the COAI (the rag tag motley group of lame assholes) has been called into question.

Calling the COAI as “assholes” is only a reflection of the personal opinion brought about by frustration because of their intense lobbying to delay any customer friendly initiative. After the broadband thingy is sorted out, I would be pressing TRAI for any information to make the telecom companies more responsive. Plus, to find out as to why they permitted the minute plans as existed before and ask them for any compensation if not in monetary terms but force the companies for any excess talk time etc etc.

This maybe a loud thinking but then we should get our money’s worth. It took a lot of time to get Vodafone to work and improve upon their services.

Wait and watch. I feel that the best is about to begin as yet. Let’s wait for the mobile number portability and the magic. The ‘revolution’ my dear friends has come NOW.

So far, I haven”t received a response. I am aware that the blog is unable to reach a majority of the Internet users; most of the potential customers also fail to check out the reviews for various ISP’s but then we are sorely limited by choice.

To me, it appears like a simple game. The “base” access is 256 kbps; anything over and above that is a “value added service”. I have no clue as to how the whole thing is priced but logic dictates that it is incremental profit for the telecom companies. The costs are fixed for “digging” up the roads, fixing up the telephone connections and if they are able to give an “error” free connection, people are loath to change their service providers in a jiffy. In any case, landlines are more reliable than a mobile connection because they are not prone for “congestion” or call drops as the case with the airwaves is.

TRAI has not addressed the customer claims so far. I remember the time when I had to struggle upfront against BSNL to start with “unlimited” connection. It was a long fight and after emailing them incessantly, I managed to get “true freedom”.

Right to Information Act has changed the game plan by giving the customer real power in terms of information. I have earlier mentioned that it is one of the most progressive legislation in the history ii independent India because the grass roots policy can be questioned to bring about a change. The appellate authority has 45 days to respond to the appeal failing which I would be escalating the matter to CIC, New Delhi and press for charges against the respective Information Officers.

I would have been happy had this case got the media scrutiny and then bring TRAI on the mat and screw them LITERALLY. For long, we have suffered enough lobbies because it doesn’t suit them. Trust me, we have enough bandwidth to support millions of ‘unlimited connections’ but are at the mercy of the likes of ISP’s like Sify and Airtel. Those associations have money, legal power and reach in the media. We as individual customers, don’t.

I find the idea to “petition” totally useless. If anything has to happen in democracy, one has to reach out to do something. Clicking on the petition is a SURE SHOT sign that you are a f***ing impotent asshole. This “clickitivism” does nothing because these petitions are as good as useless. If you are so overtly concerned about your rights, it’s a better option to hurl some stones outside their corporate offices after ganging up. Or protest outside naked with a group of people. That would generate more news rather than sitting on your sorry ass for want of doing ‘something’.

I appreciate all of your concerns and do stay glued here for any news. I shall update it as soon as I get any information.

This gets interesting.

Having the useless information from the Public Information Officer, I explored ways and means to get the FULL information from TRAI.

It appears that there is a huge lobby to keep the definition of broadband as 256 kbps which can be “offered” at an attractive “price”. Anything over and above that is chargeable at a higher price. The companies incur a fixed price to extend the wire from the exchange to your premises. However, after that, we have no clue as to how a company, for example, Airtel justifies it’s monthly costs to service me as a customer. In the recent price fall, on what basis, the price was reduced? On what basis, the earlier price point was maintained?

The PIO has not specifically mentioned about the fair usage policy. Under no circumstances, does this fair usage policy apply, nor it is mandated, nor it is ‘legal’. I have no clue about whether TRAI is aware of such a thing but in any case, it needs a follow up and TRAI should be forced to stop the unfortunate usage.

In the long term, the license of these firms needs to be made public; how these private companies acquire them, how they charge and what are their revenue sources. Their accounts need to be audited and everything should be in the public domain.

I am only interested in a bare bones 2 Mbps connection and any other value added service maybe charged for. That is a legitimate right to make a profit. However, charging exorbitant rates for something as simple as a plain vanilla broadband access is unfair and the customer needs to be put in the loop.

I am reproducing the mail to the appellate authority in full. The best part is that I don’t have to pay the requisite fees and I am sure that the PIO would be put under the mat. TRAI should exert itself as an authority and not a hand maid of the various lobbies. Lets fight them!

To,

Smt. Sadhana Dikshit,
Pr. Advisor (FA &IFA) & Appellate Authorit,
TRAI, Mahanagar Doorsanchar Bhawan,
Jawaharlal Nehru Marg,
Old Minto Road,
New Delhi-110 002.

Sub: Misleading, incoherent and incomplete reply received from PIO, Mr. P.K. Dutta vide letter No. 1(229)/2009-RTI dated 18th November 2009.

Respected Madam,

With reference to the above mentioned subject, the reply received from PIO Mr. P.K. Dutta is INCOMPLETE, INCOHERENT,ABSOLUTELY MISLEADING and NOT TO MY SATISFACTION AT ALL.

1) The definition of Broadband mentioned as per the letter is and I quote verbatim, “minimum speed of Broadband has been kept at 256 kpbs (sic) as per definition adopted by International Telecommunications Union(ITU).

After accessing the website of ITU, the picture is entirely different.
It says and I quote verbatim,” Recommendation I.113 of the ITU Standardization Sector defines broadband as a “transmission capacity that is faster than primary rate Integrated Services Digital Network (ISDN) at 1.5 or 2.0 Megabits per second (Mbits)”.
(Accessed from http://www.itu.int/osg/spu/publications/birthofbroadband/faq.html and accessed on 22nd November 2009).

Hence this information is INCORRECT AND MISLEADING a customer.

2)The question number “4, 5 and 6” in the letter to PIO dated 6th November have NOT been answered. I had specifically asked:

Does fair usage policy violate any of the provisions of TRAI?
If it does, what action can be taken against errant Internet Service Provider?
Has any Internet Service Provider been ever penalised for violating for introducing “fair usage policy?

NO ANSWERS WERE GIVEN SPECIFICALLY TO THESE IMPORTANT QUESTIONS and it amounts to WITHOLDING THE INFORMATION.
Further, If the usage of the term “FAIR USAGE POLICY” is ‘illegal’. What action has TRAI taken to notify the various Internet Service Providers to avoid the usage of term and it’s implementation for ‘reducing the speeds’ to 50%’ of the availed plan. The following definition of Fair Usage Policy is taken from Airtel available as a pdf download from their website (www.airtel.in/applications/xm/Fair_Usage_Policy.pdf)

“Under the policy we have defined fair usage levels for unlimited data transfer plans and
needless to mention, the usage levels set are very generous such that most customers will not
be affected by the Fair Usage Policy. On reaching the fair usage level, the plan speed would be rationalized by up to 50% for the restof the monthly billing cycle.”
IS TRAI AWARE OF SUCH A POLICY? WHAT ACTION HAS TRAI TAKEN TO AVOID THE USAGE OF THIS TERM?

3)Question number 8 in letter dated 6th November 2009 was specific and has NOT been answered to MY SATISFACTION, namely,
Has TRAI suggested reducing the price for various plan combinations? If yes, what is the base price fixed for an unlimited Internet Connection by any Internet Service Provider? If no, is there any provision whereby TRAI can act on behalf of the customer to reduce the prices?

I need to know whether TRAI speaks on behalf of the customers, whether TRAI asks the service providers about the break up of the various tariff plans as to under what head the various tariff plans are designed and on what basis the end customer is charged for availing the services of the various Internet Service Providers.

4)Question number 9 has NOT been answered at all namely, “ How has the tariff on unlimited broadband (1Mbps unlimited) being offered by Bharti Airtel fixed line been calculated?”

Please rush the information to me by speed/registered post at the following address listed below. In case the requisite information is not provided to me by the mandatory period, I have the option to escalate the matter to the second appellate authority namely CIC, New Delhi.

Dear Sir,

I am a citizen of India, and I request you to kindly provide me with the following information under the Right to Information Act, 2005 with regards to information relating to Broadband Internet, Fair Usage Policies and pricing mechanism.

1)Why the definition of “broadband” has been kept at 256kbps and not subject to revision for higher speeds? Is there a proposal to re-define the speed of broadband access?

The following is the text of the email sent and an edited version appeared in Business Standard on 06/11/2009.

Dear Sir,

This refers to Shyam Ponnapa’s write up on BS dated 05/110/2009 (Managing Spectrum Efficiently).

The big question. Why do we need 3G? Why not focus on the land line business alone for broadband access? Or better still. Community Wifi?

The arguments for doing away with this are many. Community Wifi is deemed to be a security risk but then countries like Singapore have implemented this on a large scale nationwide. The mobile phones required to access 3G invariably have Wifi access too. Unless, the telecom companies are expecting surefire hits like Apple iPhones or flood of other smart phones to access the Internet, it is not happening.

We don’t have accurate numbers about the likes of Reliance and Tata who are offering their 3G access. If initial reports are to be believed, they are plagued by “line of sight” hassles, ‘network congestion’ and lackluster customer support. To top it all, it has the access limitations which means that broadband access, even on the 3G spectrum would be capped for very obvious reasons.

We have enough bandwidth in the country but as anyone would testify, we have problems in implementing the “last mile access”; having a contentious set of issues like 3G is not going to solve the persistent problem of “last mile access” because no one is interested in sinking money for a long term.

We can have a fair idea from the existing companies like Airtel or Vodafone who charge exorbitant rates under the present implementation of “mobile internet”. What is the guarantee that they would lower down the prices once they pay fancy sticker prices in 3G auction?

3G, would most likely be used for carrying more voice traffic because none of the players harbours any disillusionment about the “mobile broadband” across the length and breadth of the country.
The market for value added services is locked up within the “walled garden” of the existing players; it is unlikely that 3G access would “revolutionize” the content.

This pretty much sums up what I have always alluded here and my opposition to 3G remains.
